William Hamby’s Estate in Rabun County’s Writs

While compiling Rabun County’s earliest writs and petitions for publication (available soon), I came across an 1843 court case between the heirs of the estate of William Hamby and the administrator of the estate, James Hamby. Naturally, the petition named all the heirs “to the second degree”: Ezekiel Hamby; Jonothan Roach and his wife, Huldah (Hamby) Roach; Benjamin Shelton and his wife, Keziah (Hamby) Shelton; Daniel Inman and his wife, Rebecca (Hamby) Inman; Martha Hamby; Sophia Hamby; Martha Hamby, the mother of William Hamby, the decedent; Amos Forrister and his wife Elizabeth (Hamby) Forester; James Hamby, the estate’s administrator; and Thomas K. Forrister and his wife, Polly (Hamby) Forrister.

The initial petition provides excellent information on the dynamics of this Hamby family, but there are many other documents attached to this suit, including an inventory of the estate, the sale of personal property from the estate, and the deceased’s account books,1 all of which were written into the record.2 The latter two items should be of particular interest to area researchers, even those uninterested in the Hamby family per se, because they can be used to reconstruct William Hamby’s neighborhood.

The Estate of James M. Peek, Macon Co., NC

I have recently had the privilege of sorting through the loose estate records for Macon County, as held by the North Carolina State Archives in Raleigh, for an indexing project sponsored by the North Carolina Genealogical Society. Along the way, I’ve found several interesting items on my own family that I hope to share here over the coming months with other area researchers.

One of my more recent finds was located in the file folder for James M. Peek. According to Elizabeth Peek Crutchfield in the article “David Peek”, James was the son of David Peek and Mary Henderson.1 They had the following children, including James:

  1. Eda Peek, born about 1880 [sic] in Laurens Co., SC, married John Jackson Ammons
  2. Phoebe Peek, born about 1804 in Laurens County, married James Holland
  3. William M. Peek, born 12 January 1809 in Laurens County, married Polly Avaline Mull
  4. James Peek, born before 1820 in Laurens County, “[...] with wife unknown. He migrated to Alabama.”
  5. Ruth Peek, born in 1815 in Laurens County, married Milton Moss
  6. Judy Elizabeth Peek, born in 1819 in Laurens County, married Milton McCoy
  7. Jane Caroline Peek, born 10 February 1820 in Macon Co., NC, married Andrew Madison Bryson
  8. Mary “Polly” Peek, born in 1821 in Macon County, married Martin McCoy
  9. Louisa, born in 1822 in Macon County, never married
  10. David Lee Peek, born in 1828, married Jane Moss
